Terms and Conditions

General

These Terms of Use (”Terms”) govern purchases you make on and your use of the FayeKent web site, fayekent.com, available by desktop or mobile web, (the ”Site”) controlled by [Faye Kent Art UK] (”we”, ”us” or ”FKA”).

We reserve the right to update or modify these Terms at any time without prior notice. For this reason, we encourage you to review the Terms before you make any purchase or whenever you otherwise use or access the Site. The date of the latest update is found in the final section of the Terms. If you do not agree to these Terms, please do not make any purchase or otherwise use or access the Site. Your purchase or use of the Site constitutes your agreement to follow and be bound by these Terms.

By accepting these Terms through your purchase or use of the Site, you certify that you are 18 years of age or older. If you are under the age of 18 but at least 13 years of age, you may use the Site or make a purchase only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

We do our best to ensure that information on the Site is complete, accurate and current. Despite our efforts, however, information on the Site may occasionally be inaccurate, incomplete or out of date. All products, descriptions and prices of products on the Site are subject to change at any time without notice.

Order acceptance

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have accepted your order.

Once your order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. We recommend that you save the confirmations to facilitate any future contact with our customer service.

Payment

The following payments are accepted:

1. Credit cards and debit cards

Payment can be made by the following credit cards: Visa, MasterCard, American Express, Diners, Discover, JCB and Maestro. Please note that your card is debited with the purchase amount once FKA has sent you the order confirmation email. All credit/debit card transactions on the Site are processed using Wix payments, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by FKA. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to FKA, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

2. PayPal

When selecting the PayPal option, you will be directed to the PayPal site to ”Log In” and review the amount shown before clicking ”Pay Now”. Once this transaction is complete, you will then return to the Site.

Delivery conditions

We offer different shipping methods to meet your needs as further specified when you check out.

We reserve the right to charge the full cost for uncollected packages that are returned from the shipping company to us, as well as packages that are returned due to incomplete or incorrect address from the customer as cover for shipping, handling and printing costs.

Dispatch of orders may take up to 7 business days for print only, framed prints will take longer. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If you need your purchase urgently, please contact us before placing your order so that we will have the opportunity to investigate whether we can deliver according to your wishes.

We are not responsible for any taxes/ custom fees/ additional charges that may be in place by your country when your order arrives with you. Any additional fees brought to you by customs will need to be paid by yourself.

Returns

All products are printed to order therefore we are unable to accept returns. However if your product has arrived damaged or something is wrong with it please email us at faye@fayekent.com in order to get instructions on next steps.

Defective products

If you receive defective products, please notify us immediately by e-mail to [faye@fayekent.com] and within 24 hours after you have detected that the products are defective. Please note that we will not be able to handle returned products without your prior contact with our customer service, any faulty reports made outside of 24hours after receipt will only be subject to review. The product must be in the same condition as when you received it to enable us to approve a complaint. If FKA reasonably determines that the products are in fact defective, FKA will compensate you with a non-defective similar replacement item.

Liability

FKA’s liabilities to you are limited in each separate case to these Terms unless otherwise is stipulated by law. FKA’s liabilities to you for any cause whatsoever will never exceed your total purchase amount for the order.

In no case whatsoever will FKA assume any liability for any incidental, consequential or indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters, epidemics, pandemics or similar events.

Customer registration

In order for us to fulfill your order we need to register, manage and store the personal information you provide to us.

Our processing of your personal data is collected and stored in accordance with applicable privacy laws.

Content Permission & Restrictions

Unless otherwise noted, the design of the Site, including the software, source code, text, images and all other content and materials that are part of the Site (collectively, ”Content”) are copyrights, trademarks or other intellectual properties owned, controlled or licensed by us. The Content is intended solely for your personal and non-commercial use. No right, title or interest in any Content is granted or transferred to you as a result of your use of the Site.

Except as noted herein, you may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, any of the Content or the Site. Your misuse of the Content is strictly prohibited and may subject you to liability under applicable laws.

Provisions severability

If any part of these Terms is held to be invalid or unenforceable, such determination shall not invalidate any ot her provision of these Terms; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms.
